ECO-TERRITORIAL GIVEAWAY AND LAW
THE EMERGENCE OF NATURAL RIGHTS AS A COUNTER-HEGEMONIC LEGAL POSSIBILITY FOR CONFRONTING THE CIVILIZATIONAL CRISIS IN BRAZIL

The research sought to substantiate, in theoretical terms, the emergence of recognition of the Rights of Nature by the Brazilian legal system as an alternative way out of the civilizing crisis underway in Brazil. The work was structured in conjunction with the Rights of Nature (GUDYNAS, 2019), with insertion in the interdisciplinary theoretical-methodological perspective, and study processes linked to the critical-methodological line, with a legal-sociological aspect, with dialectical reasoning and a legal- propositional. The research results present to society theoretical and legal possibilities for recognizing the Rights of Nature in the Brazilian legal-legal plan, as alternatives for development, in the face of the ongoing civilizational crisis, therefore making it possible to (re)think conflict and fundamental right to an ecologically balanced environment from the perspective of biocentric ethics and Andean indigenous worldviews enshrined in the theoretical current of Good Living.
